These Terms of Service (“Terms”) govern access to and use of our website, promotional landing experiences, communication channels, and any purchase or preorder pathway for the VitaCardex dietary supplement line. By accessing the site, creating an account if available, or submitting an order inquiry, you agree to these Terms and our Privacy Policy and Cookie Policy, incorporated by reference. If you disagree, discontinue use immediately.

1. Supplement and health disclaimers

VitaCardex is labeled and marketed as a dietary supplement under the U.S. Federal Food, Drug, and Cosmetic Act. Statements on this website have not been evaluated by the Food and Drug Administration. The product is not intended to diagnose, treat, cure, or prevent any disease. Information is for general wellness education and should not replace professional medical advice, prescription protocols, or emergency care. Individual responses differ based on genetics, medications, diet, and lifestyle.

You agree to consult a licensed healthcare provider before starting VitaCardex if you are pregnant, nursing, planning surgery, taking anticoagulants, potassium-sparing drugs, blood-pressure medications, or if you manage chronic cardiovascular, renal, hepatic, or endocrine conditions. You are responsible for verifying ingredient compatibility with your allergies.

2. Eligibility and geographic scope

You must be at least eighteen years old and capable of forming a binding contract to place orders or create accounts. While informational content is broadly accessible, we may restrict fulfillment to jurisdictions where logistics, labeling, and registration requirements are satisfied. Offers denominated in U.S. dollars primarily target domestic consumers; currency conversion fees may apply if your bank settles in another denomination.

3. Account security

If password-protected areas are introduced, you must provide accurate registration data, safeguard credentials, promptly notify us of unauthorized access, and refrain from sharing accounts. We may suspend accounts that show fraud indicators, bot activity, or violations of these Terms.

4. Orders, pricing, and acceptance

Product listings, images, and prices constitute invitations to treat—not binding offers—until we send an order confirmation acknowledging receipt and acceptance. Published prices, including promotional $39.90 positioning versus $59.90 reference pricing, may change without notice except where a fixed quotation was individually approved in writing. Applicable sales tax and shipping appear before payment capture when checkout modules are active. We may decline or cancel orders affected by supply disruptions, export restrictions, manifest errors, suspected fraud, or excessive returns history.

Preauthorized payment holds may appear on your card statement; final settlement occurs upon shipment unless otherwise disclosed. If we cancel after payment, we will refund the captured amount through the original payment rail unless regulations require an alternative instrument.

5. Shipping and title

Risk of loss passes to you upon tender to the carrier unless mandatory consumer laws dictate otherwise. Delivery dates are estimates; weather, customs, or carrier backlogs may extend timelines. You must provide deliverable addresses. Reshipping fees may apply if carriers return parcels due to inaccurate information or unclaimed packages.

6. Payments and fraud prevention

We or our processors may use automated and manual tools to validate cards and addresses, challenge high-risk transactions, or request identity documents where justified. You authorize us to charge provided payment sources for authorized amounts. Chargebacks initiated in bad faith may result in account closure and debt collection after good-faith dispute resolution.

7. Intellectual property

All trademarks, trade dress, copy, diagrams, photography, and software on the site belong to the Company or licensors. You receive a limited, revocable, non-exclusive license to browse and print excerpts for personal noncommercial use. Any scraping, framing, deep linking that impairs server performance, or training of machine learning models on our content without written permission is prohibited.

8. Acceptable use

You agree not to: (a) violate laws or third-party rights; (b) upload malware or probe vulnerabilities; (c) harvest personal data of other users; (d) send unsolicited bulk messages referencing our brand; (e) impersonate the Company or partners; (f) attempt to circumvent technical controls or consent mechanisms; (g) submit false medical emergencies to support channels.

9. User content

If you post reviews, testimonials, or attachments, you grant us a worldwide, royalty-free license to host, reproduce, and display such content in connection with VitaCardex marketing, subject to Privacy Policy constraints. You represent that submissions are truthful to your experience, non-defamatory, and free of third-party proprietary encumbrances. We may moderate or remove content that breaches law or community guidelines.

10. Third-party services

The site may link to carriers, payment brands, or regulatory repositories. Their terms govern those interactions. We are not responsible for outages, security lapses, or billing disputes arising solely from third-party platforms.

11. Disclaimer of warranties

EXCEPT WHERE PROHIBITED, THE SITE AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW. WE DO NOT WARRANT UNINTERRUPTED ACCESS OR ERROR-FREE CONTENT.

12. Limitation of liability

TO THE FULLEST EXTENT ALLOWABLE IN NEW YORK AND YOUR STATE OF RESIDENCE, OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE PRODUCTS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE EVENT OR (B) ONE HUNDRED U.S. DOLLARS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF POSSIBILITY. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES OUR LIABILITY IS LIMITED TO THE MINIMUM LEGALLY PERMITTED.

13. Indemnity

You will defend, indemnify, and hold harmless the Company, its officers, employees, and agents from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the site, violation of these Terms, infringement of third-party rights, or negligent handling of VitaCardex contrary to label guidance.

14. Dispute resolution and governing law

These Terms are governed by the laws of the State of New York, excluding conflict-of-law principles that would apply another jurisdiction’s rules. Subject to applicable consumer protections, you consent to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York for disputes exceeding small-claims thresholds. We each waive any right to a jury trial where waiver is enforceable.

If you reside in the European Economic Area or United Kingdom, mandatory consumer protections and venue rules in your country of residence may supersede this paragraph to the extent non-waivable.

15. Informal resolution

Before initiating formal proceedings, you agree to email contact@khivaronquebl.world with a concise description of the dispute and desired outcome. Parties will negotiate in good faith for thirty calendar days.

16. Force majeure

We are not liable for delays caused by events beyond reasonable control, including natural disasters, pandemics, wars, sanctions, labor stoppages, supplier insolvencies, or critical infrastructure failures.

17. Assignment

We may assign these Terms in connection with mergers, acquisitions, or asset sales after providing notice where required. You may not assign without our written consent.

18. Severability and waiver

If any provision is invalid, the remaining provisions remain effective. Failure to enforce a right is not a waiver unless in signed writing.

19. Electronic communications and signatures

You consent to receive policies, receipts, and service messages electronically. Electronic records satisfy legal writing requirements where permitted.

20. Changes

We may update these Terms by posting revisions with a new effective date. Material changes affecting price, liability, or dispute resolution will be highlighted for thirty days when feasible. Continued use constitutes acceptance unless law requires express consent.

21. Compliance representations

You represent that purchase addresses are truthful, payment methods are authorized, and you will not resell VitaCardex in violation of distributor agreements or FDA/FTC advertising obligations. We may request business credentials before fulfilling unusually large or cross-border orders.

22. Injunctive relief for misuse

Notwithstanding the dispute process, either party may seek provisional injunctive relief in competent courts to prevent irreparable harm from intellectual property infringement, security intrusions, or unlawful product diversion.

23. Export controls

You warrant compliance with U.S. Export Administration Regulations and sanctions programs. We refuse transactions destined for embargoed regions or restricted parties lists maintained by competent authorities.

24. Language precedence

The English version of these Terms controls for international interpretation. Translations may be offered for convenience; discrepancies revert to English except where local law mandates a particular language.

25. Contact

Questions about these Terms should be directed to contact@khivaronquebl.world or the postal address at the top of this document.
